(1) Before the town council’s approval is certified on the final plat, the subdivider shall either install required improvements and repair any existing roads and other public facilities damaged in the development of the subdivision, or execute and file with the town council an agreement between himself and the town specifying the period within which required improvements and repairs shall be completed. The agreement shall provide that if the work is not completed within the period specified, including any approved extensions of time, the town may complete the work and recover the full cost and expense thereof from the subdivider. The agreement may provide for the construction of the improvements in units and for extension of time under specified conditions.

(2) In addition, the agreement must contain a provision whereby the subdivider will be responsible for the successful operation and repair of the improvements for a one-year period following the inspection and acceptance by the town of this installation; except, that all drainage improvements shall be for a two-year period. The agreement shall allow for the construction of pedestrian walkways to be completed within three years of the recording of the final plat, or immediately following the construction of each residence, whichever occurs first.
