It shall be the duty of the town marshal or any police officer to deliver to the parent, guardian or other person having the care and custody of such minor who shall be in violation of this chapter upon such parent, guardian or other person having the care and custody of such minor entering upon a recognizance for the appearance of such minor before the police judge at such time as may be fixed for the hearing of the complaint in such manner.
