(1) The examiner shall receive and examine all available information, conduct public hearings, prepare a record thereof, consider the applicable permit criteria, and enter decisions or recommendations for the following matters in accordance with the procedural chapters herein cited:

(a) Perform the functions and exercise the powers and duties of the Board of Appeals as set forth in Section 205 of the Uniform Code for the Abatement of Dangerous Buildings as adopted by reference pursuant to Chapter 15.15 CMC.

(b) Perform the functions and exercise the powers and duties of the board of adjustment as set forth in Chapter 18.60 CMC. The decision of the hearing examiner shall be final.

(c) Perform the functions and exercise the powers and duties of the Board of Appeals as set forth in Section 108 of the International Fire Code as adopted by reference pursuant to CMC 15.10.010.

(d) Perform the functions and exercise the powers and duties of the Board of Appeals as set forth in the applicable sections of the current editions of the International Building Code, the Uniform Plumbing Code, and the International Existing Building Code, as adopted by reference pursuant to CMC 15.10.010.

(e) Appeals relating to the administration of Chapter 14.10 CMC (Flood Damage Prevention) as set forth in CMC 14.10.170.

(f) Appeals relating to variances and the administration of Chapter 14.15 CMC (Critical Areas) as set forth in CMC 14.15.140 and 14.15.150.

(g) Such other matters as the town council may refer.

(2) The examiner’s decision on permit applications may be to grant or deny the application, or the examiner may require of the applicant such conditions, modifications and restrictions as the examiner finds necessary to make the application compatible with its environment and carry out the objectives and goals of the comprehensive plan, the development code, and other codes and ordinances of the town of Cathlamet and applicable state and federal laws.
